What is SNAP?

SNAP, or “Supplemental Nutrition Assistance Program,” is a federal aid program designed to keep you from starving. Think government money for free food so you can feed your hunger pangs. Wow, what a nice icing on the cake! But wait, they’re not that generous. SNAP means you can’t buy anything you want; you have to eat what the plan says, like fruits, vegetables, and milk – no alcohol, cigarettes, vitamins, or prepared foods. So, if you’re not earning enough in the US or you’re on a tight budget, SNAP is there to “help” you out.

Under the SNAP plan, you can purchase most food items such as fruits, vegetables, bread, dairy products, meat, poultry, fish and non-alcoholic beverages. But you cannot buy non-food items, alcohol, tobacco, vitamins, supplements, hot cooked meals or restaurant meals (except in some cases, such as for elderly or disabled persons).

Which non-citizens can claim SNAP?

  • Not all non-citizens can claim SNAP. According to the USDA,
  • only those non-citizens who are legally present in the US can avail SNAP benefits.
  • Non-citizens living illegally, students, and tourists cannot claim SNAP.
  • Although legal citizens also have to meet special eligibility criteria for SNAP,
  • All children under the age of 18 can take advantage of this scheme, regardless of their status.

Groups that are eligible immediately

There are some groups that Noncitizens are immediately eligible if they meet SNAP’s general financial and nonfinancial criteria. These include:

  • refugees who have been granted asylum,
  • victims of aggravated trafficking,
  • those protected from deportation,
  • Americans and Cuban and Haitian entrants, Iraqi and Afghan special immigrants (SIVs).

In addition, certain foreign-born American Indians, Hmong or highland Laotian tribal members, and Compact of Free Association (COFA) citizens of Micronesia, the Marshall Islands and Palau may also be immediately eligible for SNAP.

Who must wait five years?

Some noncitizens must wait five years to receive SNAP benefits. These include: legal permanent residents (LPR) or green card holders who have been paroled for at least one-year, conditional entrants and paroled noncitizens.

You don’t have to wait if…

However, there is no wait in some cases, such as: if you are under 18 years of age, are blind or disabled and are receiving assistance for your condition, if you were living in the US on or before August 22, 1996 and are 65 years of age or older, if you have any connection to the US military, or if you are an Afghan or Ukrainian who has been paroled.
